Tennessee Small Business Insurance
Tennessee small business insurance has its own rulebook. The state averages 32 tornadoes a year, runs the Southeast's lowest workers' comp rate at about $0.98 per $100 of payroll, and uses a split workers' comp rule that catches many construction owners off guard.
This guide covers the decisions and traps that actually matter in TN.
The Workers' Comp Trap
Tennessee Code §50-6-902 splits the rules in two. Non-construction employers need coverage at 5 employees. Construction service providers need it at 1.
Penalties run from $50 to $10,000 per violation. If a worker is injured while you're uninsured, it becomes a Class A misdemeanor with possible jail time up to 11 months and 29 days. Construction owners can apply for exemption on themselves through the state's Exemption Registry, but employees still need coverage.
See workers' compensation insurance for how policies are structured.
Storm Premiums
NOAA logged 116 billion-dollar weather events in TN from 1980 to 2024, averaging 7.8 per year over the last five. Shelby, Davidson, and Rutherford counties absorb the most tornado activity. Property quotes reflect it.
- Wind and hail typically carry a separate deductible, often 1% to 5% of the building limit
- Most TN forms apply that percentage to any wind event, not just named storms
- Ordinance or law coverage matters in older buildings since code upgrades after damage can exceed the base repair cost
A business owner's policy packages property and liability together.
The $25K Contractor Rule
The Tennessee Board for Licensing Contractors (TBLC) requires licensing on projects of $25,000 or more under TCA §62-6-101. Residential work between $3,000 and $24,999 falls under Home Improvement Contractor (HIC) rules. License tiers run from BC-A (unlimited) down through BC-F.
Match your TBLC monetary limit to the jobs you actually bid. Underwriters check it, and bidding above your limit can create coverage disputes if a claim hits. Public and larger private jobs also call for surety bonds.
The Auto Gap
TN's mandatory minimum is 25/50/15 under TCA §55-12-102. It's the floor to drive legally and rarely enough for a business vehicle. Most commercial contracts require 1M combined single limit.
- Vehicles over 10,001 lbs GVWR trigger higher federal motor carrier minimums
- For-hire passenger vehicles carrying 8+ passengers require $1M under TCA §65-15-116
- Hired and non-owned auto covers employees driving personal vehicles for work, which their personal policies usually exclude
See commercial auto insurance for what owned, hired, and non-owned coverage actually responds to.
Service and Advice Work
Nashville healthcare and tech, Memphis logistics, and professional services across TN often need professional liability (E&O) on top of general liability. GL handles bodily injury and property damage. E&O handles claims tied to the work itself: missed deadlines, faulty advice, contractual KPIs.
Most E&O policies are claims-made. Watch the retroactive date when switching carriers. Cyber liability is now standard in many vendor contracts.
TN Claim Files
Real client situations, details changed. Outcomes vary by policy form.

Cost Ranges
- General liability: $400 to $1,500 a year for most small businesses at 1M/2M
- Workers' comp: about $0.98 per $100 of payroll on average, varies sharply by class code
- BOP: $700 to $2,000 a year for small office or retail
- Commercial auto: $1,200 to $2,500 a year per vehicle at 1M CSL
- Professional liability: $500 to $1,200 a year for most small service firms at 1M
County, payroll, class codes, vehicle types, and claims history move these ranges. Your quote depends on your operations.

FAQs
Construction sole prop with no employees, do I need workers' comp?
Often yes, under §50-6-902, unless you're on the Exemption Registry or meet a specific exception. Confirm with the Bureau.
What GL limits will a Nashville landlord want?
Usually 1M per occurrence and 2M aggregate, with the landlord as additional insured. Read the lease before quoting.
Does my homeowners policy cover my home-based TN business?
Usually not beyond a small limit. A BOP or home-business endorsement closes the gap.
BC-A vs BC-B vs HIC?
BC-A: unlimited project value. BC-B: up to $1.5M. HIC: residential $3K-$24,999. Each has its own financial and exam requirements.
How does TN tornado risk affect my property quote?
County drives a lot of it. Storm-prone counties pay more, often with 1%-5% wind/hail deductibles. Roof age and construction type matter too.
How long until TN workers' comp disability benefits start?
7-day waiting period. Benefits become retroactive if disability lasts 14 days or longer.
Can I add subcontractors to my workers' comp policy?
Under §50-6-902(c), a construction sub can elect coverage under the GC's policy with a signed agreement filed with the bureau.
