These Terms & Conditions (“Terms” or “Terms of Use”) govern your access to and use of the websites, online applications, portals, forms, quoting tools, and related services offered by USA Business Insurance Services, Inc. (“USA Business Insurance,” “we,” “us,” or “our”).

In California, we do business as American Liability Insurance (where applicable).

By accessing or using our Services, you agree to these Terms. If you do not agree, do not use the Services.

Important Notice About Insurance

  • We are an independent insurance agency. We are not an insurance company.

  • Coverage is subject to underwriting approval and may not be available in all states.

  • Policy terms control. All insurance products are governed by the terms, conditions, limitations, and exclusions of the issued policy.

  • Claims decisions and policy obligations are the responsibility of the issuing insurance company.

  • Content on our website may be provided for general educational purposes and is not legal, tax, or individualized insurance advice.


1) Definitions

  • “Services” means our websites, applications, widgets, forms, portals, email or SMS notifications, and any other mediums or tools through which you access our content, request quotes, purchase insurance (where available), service policies, or communicate with us.

  • “Website” includes any site or subdomain we operate, including customer or policy portals and quoting experiences.

  • “You” means any user of the Services and any entity you represent.


2) Privacy Policy and Cookie Practices

Your use of our Services is also governed by our Privacy Policy, which describes how we collect, use, store, and share information, including through cookies and similar technologies.

By using the Services, you acknowledge that you have read and understood our Privacy Policy and agree to the data practices described there.


3) Eligibility and Authority

By using the Services, you represent that:

  • You are at least 18 years old and have legal capacity to agree to these Terms.

  • If you are using the Services on behalf of a business or other organization, you have authority to bind that organization to these Terms.


4) Information You Provide; Accuracy; Consent for Third‑Party Information

You are responsible for anything you transmit to or through our Website, portals, forms, email, phone, SMS, or public channels (including social platforms or reviews).

You agree that any information you provide will be truthful, accurate, current, not misleading, and provided in good faith, and that you have the authority to provide it (including any information about other people, such as owners, employees, drivers, or additional insureds).

Commercial Auto — Employee/Driver Records

If you request or apply for commercial auto coverage, you represent that you have provided required notices to and obtained any legally required consents from employee/drivers to allow us and/or insurers to obtain motor vehicle records and related reports for underwriting and eligibility decisions (as permitted by law).


5) Data Collection Even When We Cannot Offer Coverage

You understand that we may collect data (including personal data, as described in the Privacy Policy) even if we cannot offer a quote, product, or service at the time. If you voluntarily provide information to us, you agree we may use it in ways consistent with the Privacy Policy, including for market analysis, advertising, and other business purposes, to the extent permitted by law.


6) Consent to Electronic Delivery of Insurance Documents

By using our Services and providing contact information (including an email address), you consent to receive insurance documents and communications electronically, including identification cards, notices, policy documents, endorsements, billing communications, and other documents, as available.

You are responsible for maintaining current contact information and for reviewing documents we send.


7) Permitted Use of Our Services

Our Services and any underlying processes, content, and generated data may be used only for your personal or business informational use in connection with evaluating, requesting, purchasing (where available), or servicing insurance products.

Unless we provide prior written consent, you may not:

  • copy, reproduce, sell, distribute, republish, transmit, broadcast, license, scrape, or exploit our Services, processes, content, or generated data;

  • use our Services to build or support a competing product or lead database;

  • transfer your access rights to another person or entity.

We may suspend or discontinue any part of the Services at any time (for example, for maintenance, security, legal compliance, vendor interruptions, or business reasons).


8) Prohibited Activities

You agree not to engage in prohibited activities, including without limitation:

  • fraud, harassment, spamming, or unlawful conduct;

  • copyright, trademark, patent infringement, or theft of trade secrets;

  • advertising to or soliciting users to buy/sell goods or services unrelated to the Services;

  • automated access (scripts, bots, scraping, bulk form submissions, automated messaging);

  • interfering with, disrupting, or overloading our Services or networks;

  • impersonation or misrepresentation of identity;

  • using false contact information or using someone else’s information without authorization;

  • using information from our Services for any purpose that violates these Terms or applicable law.


9) Monitoring and Enforcement; Termination

We may (but are not required to) monitor activity on our Services to enforce these Terms and protect our customers, business, and rights.

If we believe you violated these Terms, we may restrict, suspend, or terminate your access (or refuse service), remove content, or take other appropriate action, as permitted by law.


10) Website Content; “As‑Is” Disclaimers

We do not promise that the content on our Services will meet your needs, be uninterrupted, error‑free, complete, or always current.

To the fullest extent permitted by law, the Services and all content are provided “as‑is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, title, non‑infringement, or fitness for a particular purpose.

We do not guarantee that any downloadable content is free from viruses or other harmful components.


11) Quotes, Offers, and Availability

We do not guarantee quotes or offers shown on or through our Services. Pricing and eligibility may change based on underwriting, additional information, inspections, audits, loss history, claims history, or carrier requirements.

Our Services are intended for use in the United States. If you access the Services from outside the U.S., you do so at your own risk and are responsible for complying with local laws. Any offers are void where prohibited.


12) Our Role; Carriers and Partners

We act as an insurance agent representing insurance companies to which we may submit your application and from which coverage may be procured (if approved). We may also work with wholesale brokers, MGAs, underwriting partners, or other intermediaries to access markets.

Carrier participation, appetite, and availability vary by risk and state and may change without notice.


13) Third‑Party Providers; Financial Decisions

Our Services may provide access to information and third‑party providers of products or services. Unless expressly stated, we do not endorse or recommend third‑party providers, and we do not guarantee that such providers are appropriately licensed, qualified, or suitable for your needs.

You are responsible for evaluating third‑party products and services and for any agreements you enter into with third parties.

We encourage you to consult qualified professionals (e.g., legal, accounting, and insurance professionals familiar with your circumstances) before making financial or insurance decisions.


14) Fees, Billing, Payments, Refunds, and Premium Audit

A. Fees and refunds

Many parts of our Services are free to use. If you purchase insurance or related services, you may be charged premiums, taxes, and fees. By submitting payment information for an accepted payment method (“Payment Method”), you authorize us (and/or insurers or finance companies, as applicable) to charge agreed amounts and applicable taxes/fees.

Refunds are provided only as required by law, by the applicable insurer/finance company terms, or as otherwise expressly stated.

B. Premium audit / deposit premium

Some policies are subject to premium audit. The premium shown on proposals or invoices may be a deposit premium for the policy period. Carriers may review your business records and adjust premium based on actual exposures.

C. Payment authorization; unauthorized payment method use

If you use a credit/debit card, you represent you are authorized to use that Payment Method. Unauthorized use does not eliminate your obligation to pay amounts due, and we may report misuse to the appropriate authorities.

D. Monthly payments and recurring billing

If you choose monthly billing and provide or designate a Payment Method, you authorize recurring charges. Monthly billing amounts may vary due to endorsements, changes, taxes, fees, audits, or other adjustments.

E. Binding and underwriting approval

Payment does not bind coverage. Coverage is not in force unless and until the insurance carrier approves the application and confirms coverage according to its procedures.

F. Cancellation

You may request cancellation by calling (888) 900‑0205. If a scheduled payment is not made when due, we and/or the insurer or finance company may request or process cancellation as permitted by the policy terms and applicable law.


15) Compensation Disclosure

We and our partners (including brokerages, underwriting services, and consultants) may receive commissions, fees, or other compensation in connection with insurance transactions and related services. If you have questions about compensation related to your policy, contact us.


16) Your Representations to Us (Including FCRA Authorization)

By using our Services (including requesting quotes or applying for insurance), you represent and warrant that:

  • You are authorized to purchase and bind insurance on behalf of the entity applying for coverage.

  • You have not had judgments or liens placed against you in the last three (3) years (when that information is requested as part of an underwriting/eligibility process).

  • You authorize us and our representatives to obtain consumer reports governed by the Fair Credit Reporting Act (FCRA) for permissible purposes related to underwriting, eligibility, and other permitted uses. If adverse action is taken based on a consumer report, you will be notified as required by law, including a summary of your rights.

If any of these statements are not true, you are not authorized to use our Services for quoting or purchasing.


17) Indemnification

To the extent permitted by law, you agree to indemnify, defend, and hold harmless USA Business Insurance and its affiliates, officers, directors, employees, and agents from claims, costs, fines, damages, and expenses (including attorneys’ fees) arising from or related to your use of the Services or your violation of these Terms.


18) Intellectual Property

Our names, logos, graphics, page layouts, icons, scripts, and terminology used with the Services may be protected trademarks and trade dress (“Proprietary Marks”). You may not use them without our prior written permission.

Content available on our Services is copyrighted or licensed to us or our suppliers. You do not obtain any ownership rights by using the Services.


19) No Third‑Party Beneficiaries

These Terms are between you and us. No other person or entity has rights under these Terms.


20) Assignment

You may not transfer, assign, or license your rights under these Terms without our prior written consent.


21) Not Intended for Minors

Our Services are not directed to persons under 18, and we do not knowingly collect personal information from minors.


22) Governing Law; Jurisdiction

These Terms are governed by the laws of the State of California, without regard to conflict‑of‑law rules. To the extent any dispute is handled in court (including enforcement of an arbitration award), you agree to jurisdiction and venue in California state or federal courts.


23) Arbitration Agreement and Class Action Waiver

A. Arbitration

Any controversy or claim arising out of or relating to these Terms or your use of the Services shall be resolved by binding arbitration after the parties’ good‑faith efforts to settle the dispute.

Arbitration will be administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules and applicable consumer procedures, except any rules permitting class actions or conflicting with these Terms.

B. Waiver of class remedies

Arbitration will be conducted only on an individual basis. You and we waive the right to participate in class actions or representative proceedings.

If a court or arbitrator determines the class waiver is unenforceable or that arbitration may proceed on a class basis, this arbitration provision shall be null and void in its entirety.

C. Small claims exception

Either party may seek relief in small claims court for disputes within that court’s jurisdiction, subject to the Governing Law/Jurisdiction provisions above.


24) No Oral Modification

These Terms may not be modified by oral statements. Employees, partners, and affiliates are not authorized to modify these Terms except through an updated written posting by us.


25) Communications Consent (Phone, Email, Text, Mail)

If you submit contact information to us in connection with a quote request, policy service request, or inquiry, you consent to receive communications related to your request, including by phone call, email, text message, and mail, consistent with applicable law and your choices.

Some communications are necessary for service reasons (for example, quoting, underwriting follow‑ups, billing, renewals, or policy servicing). Where required, you may opt out of marketing communications by following the instructions provided in the message or by contacting us.


26) Licensing and State Producer License Numbers

USA Business Insurance Services, Inc. is licensed to operate in all 50 U.S. states. For transactions requiring an active insurance license, we operate under USA Business Insurance Services, Inc., and in California as American Liability Insurance.

27) Severability; Non‑Waiver; Force Majeure; Entire Agreement

If any provision is unenforceable, the rest remains in effect. Failure to enforce a right is not a waiver. Neither party is liable for delays caused by events beyond reasonable control (acts of God, war, riots, government restriction, labor issues, epidemics/quarantine, fire, flood, earthquake, etc.). These Terms and the policies incorporated by reference are the entire agreement regarding your use of the Services.


28) Changes to These Terms

We may update these Terms from time to time. When practicable, we will post material changes with notice at least 30 days before the effective date. If you do not agree to material changes, you may stop using the Services.


29) Notices

You consent to receive notices related to these Terms by posting on the Website, by email to the address you provided, and/or by mail to the address you provided.
