Who Needs Mortgage Broker Insurance

General Liability Insurance for Mortgage Brokers

General liability covers third-party bodily injury and property damage tied to your premises and operations: a client who trips in your office, or damage you cause to a leased suite. It does not touch professional mistakes.

Expert insight. The real friction is the certificate: landlords often want a general liability policy that names them as additional insured, primary, and noncontributory. Check your lease for those words before you sign.

Claim story. A broker in Arizona had a referral partner catch a heel on a frayed lobby rug, fracturing a wrist. The medical and lost-time demand came in around $24,000. Does general liability cover a mistake on a loan file?
No. Loan errors and bad advice fall under professional liability (E&O), not general liability. You generally need both.

Business Owner's Policy (BOP) for Mortgage Brokers

A BOP bundles general liability with commercial property and business income (lost revenue if a covered event shuts your office). For a brokerage, the property side mostly means computers, monitors, furniture, and tenant improvements.

Expert insight. Insure equipment at replacement cost, not actual cash value (ACV, which subtracts depreciation), and don't rely on the thin built-in cyber. A home-based broker needs a small office package or a business owner's policy, since homeowners' coverage excludes business activities.

Is a BOP cheaper than buying policies separately?
Usually, yes. Bundling general liability and property into a BOP is typically more cost-effective for a low-hazard office than standalone policies, though it varies by carrier.

 

Commercial Auto Insurance for Mortgage Brokers

Commercial auto covers liability and physical damage for business-owned vehicles. If you drive to closings, appraisals, or client meetings, this policy applies to an at-fault accident while on company business.

Expert insight. When staff drives personal cars for work, their own insurer can deny a business-use claim. Add a hired and non-owned auto endorsement, or carry a full commercial auto policy for any company-titled vehicle.

Do I need commercial auto if nobody drives a company car?
Often, you still want hired and non-owned auto. It protects the business when employees use personal vehicles for work errands.

Excess Liability Insurance for Mortgage Brokers

Excess liability, sometimes structured as an umbrella, sits on top of your general liability, auto, and (where allowed) employer's liability. It imposes limits when a covered judgment or settlement exceeds the underlying policy.

Expert insight. Excess won't raise your E&O limits, since umbrellas exclude professional services. It earns its keep on a large auto or premises claim, and an excess liability policy is the cheap way to meet a partner's minimum-limit demand.

Is excess liability the same as higher E&O limits?
No. Standard umbrellas exclude professional services. To raise E&O limits, you increase the E&O policy itself, not the umbrella.

 

Cyber Liability Insurance for Mortgage Brokers

Cyber liability covers the costs of a breach or fraud involving your systems and client data: forensics, notification, credit monitoring, regulatory defense, and in many forms, funds lost to social-engineering or wire fraud. For a brokerage holding Social Security numbers, bank details, and W-2s, this is core, not optional.

Claim story. A Florida brokerage got a spoofed email that looked like the title company and wired about $48,000 in closing funds to a criminal account. Doesn't my BOP already include cyber?
Rarely enough. Base BOP cyber sublimits are usually small. A standalone cyber policy with a funds-transfer-fraud limit is the realistic fit.

 

Professional Liability (E&O) Insurance for Mortgage Brokers

Errors and omissions insurance is the headline coverage. It defends and pays claims alleging a professional mistake: a missed rate lock, a TRID or RESPA disclosure error, a wrongful denial, a botched lock extension, or advice a borrower says cost them money.

Expert insight. E&O is claims-made, so never let it lapse and buy tail coverage when you switch carriers. Also, the E&O a warehouse lender or GSE requires is not everyday broker E&O, so start with a true mortgage broker E&O policy under the professional liability umbrella, then add the lender-required form.

Claim story. A broker in Colorado failed to extend a rate lock before a delayed closing, and the borrower's rate jumped. The borrower's claimed loss over the life of the loan was framed at about $19,000. The E&O policy funded defense and a negotiated settlement well below the demand, and the client kept the relationship.

Is E&O required by law for mortgage brokers?
Usually not by state license law, but warehouse lenders, investors, and the GSEs commonly require it by contract. In practice, most brokers cannot operate without it.

Workers' Compensation Insurance for Mortgage Brokers

Workers' compensation pays medical bills and lost wages for employees hurt on the job, and it is mandatory in nearly every state once you have staff. A brokerage is low-hazard office work, so rates are among the lowest on the schedule.

Do owners have to cover themselves?
Often you can exclude owners or officers, depending on state rules and entity type. Employees almost always must be covered.

 

Surety Bonds for Mortgage Brokers

A mortgage broker surety bond is a license requirement in most states under the SAFE Act, filed electronically through NMLS as an Electronic Surety Bond (ESB). It guarantees that you will follow state mortgage law, and it protects borrowers, not you.

Expert insight. A bond is not insurance: if the state pays a claim, you repay the surety in full. The state sets the amount, often by loan volume and adjusted yearly (riders due by March 31), and we place it with your other surety bond needs.

How much does a mortgage broker bond cost?
You pay a premium that is a small percentage of the bond amount, commonly in the low single digits for strong credit. The bond face amount itself is set by your state.

 

Common Mistakes Mortgage Brokers Make With Insurance

  • Treating E&O as optional. Loan errors are the most expensive claims a brokerage faces, and general liability will not touch them.
  • Letting claims-made E&O lapse. A gap between policies, or no tail when you switch carriers, can leave a real claim with no coverage.
  • Ignoring wire fraud. Brokers assume the bank or title company absorbs a diverted wire. Often nobody does, unless your cyber policy has a social engineering limit.
  • Forgetting the bond rider. Loan volume grows, the required bond amount grows, and a missed annual adjustment can hold up your NMLS renewal.
  • Buying generic coverage. Off-the-shelf small-business policies rarely match GSE, warehouse-lender, or FTC Safeguards Rule expectations for a financial institution.

Other Coverage Mortgage Brokers May Need

  • Fidelity bond/crime coverage. Protects against employee theft and dishonesty, and is frequently paired with E&O to satisfy GSE and warehouse-lender requirements.

State Requirements for Mortgage Broker Coverage

Rules vary by state and change often, so treat the points below as a starting map and verify with your regulator and the NMLS.

  • Surety bond (most states). Required for licensing through NMLS as an Electronic Surety Bond, with the amount set by the state and frequently tied to loan volume. Examples range from a $20,000 minimum at initial licensing in Washington, to $75,000 for a Massachusetts mortgage broker, to $50,000 for a California lender/servicer, to $10,000 to $100,000 for a New York originator, to $75,000 and up in North Carolina.   • Workers' compensation (nearly all states once you hire). Required when you have employees, with limited owner or officer exemptions. Texas is the well-known outlier where private coverage is elective, though going without it carries its own risks.
  • Commercial auto (all states, for owned vehicles). Business-owned vehicles must meet each state's auto liability minimums.
  • E&O and fidelity (contract-driven, not usually state license law). Commonly required by warehouse lenders, investors, and the GSEs rather than by your state, though a few states attach E&O or fidelity conditions to certain licenses.
  • Data security (federal, all states). The FTC Safeguards Rule applies to mortgage brokers nationwide, independent of any state insurance mandate.
