But from a tax, legal, and insurance standpoint, self-employed and independent contractors are not the same thing. Under <a href=\"https:\/\/www.irs.gov\/businesses\/small-businesses-self-employed\/independent-contractor-defined\" target=\"_blank\" rel=\"noreferrer noopener\">IRS guidance<\/a>, every independent contractor is self-employed, but self-employed status is broader and also includes sole proprietors, partnership members, gig workers, and others who are in business for themselves.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-what-is-an-independent-contractor\">What Is an Independent Contractor?<\/h2>\n\n\n\n<p>The <a href=\"https:\/\/www.irs.gov\/businesses\/small-businesses-self-employed\/independent-contractor-defined\" target=\"_blank\" rel=\"noreferrer noopener\">IRS says<\/a> an individual is generally an independent contractor when the person paying for the work has the right to control only the result of the work, not what will be done and how it will be done. In practical terms, that usually means the client cares about the finished job, while the contractor controls the method, workflow, tools, and day-to-day execution.<\/p>\n\n\n\n<p>That said, <a href=\"https:\/\/www.businessinsuranceusa.com\/blog\/insurance\/business-insurance-industry-classifications\/\" target=\"_blank\" rel=\"noreferrer noopener\">worker classification<\/a> is not decided by one label, one contract, or one scheduling detail. The <a href=\"https:\/\/www.irs.gov\/businesses\/small-businesses-self-employed\/independent-contractor-self-employed-or-employee\" target=\"_blank\" rel=\"noreferrer noopener\">IRS looks <\/a>at the full relationship and weighs behavioral control, financial control, and the type of relationship. There is no magic number of factors, and no single factor stands alone. A contract that calls someone an independent contractor can help show intent, but it does not control the result by itself.<\/p>\n\n\n\n<p>A simple example helps. A <a href=\"https:\/\/www.businessinsuranceusa.com\/business-insurance-web-designers\" target=\"_blank\" rel=\"noreferrer noopener\">web designer<\/a> hired for a one-time project, using their own tools, setting their own process, and marketing services to other clients, may fit the contractor status. Someone doing the same work under close supervision, fixed procedures, and ongoing employer control may not.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-what-is-a-self-employed-person\">What Is a Self-Employed Person?<\/h2>\n\n\n\n<p>Self-employed is the broader category. <a href=\"https:\/\/www.irs.gov\/businesses\/small-businesses-self-employed\/self-employed-individuals-tax-center\" target=\"_blank\" rel=\"noreferrer noopener\">IRS guidance says<\/a> you are generally self-employed if you carry on a trade or business as a sole proprietor or independent contractor, are a member of a partnership, or are otherwise in business for yourself. That means self-employed people may sell services, sell products, operate part-time, or run a full-scale business.<\/p>\n\n\n\n<p>The easiest way to think about it is this: an <a href=\"https:\/\/www.irs.gov\/businesses\/small-businesses-self-employed\/independent-contractor-defined\" target=\"_blank\" rel=\"noreferrer noopener\">independent contractor<\/a> is one common type of self-employed worker, but not every self-employed person is an independent contractor.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-how-do-self-employed-people-get-paid-and-report-income\">How Do Self-Employed People Get Paid and Report Income?<\/h2>\n\n\n\n<p>Because there usually is no employer withholding payroll taxes, self-employed individuals generally file an annual return, pay income tax and self-employment tax, and make estimated tax payments during the year. The IRS points self-employed taxpayers to <a href=\"https:\/\/www.irs.gov\/businesses\/small-businesses-self-employed\/self-employed-individuals-tax-center\" target=\"_blank\" rel=\"noreferrer noopener\">Form 1040-ES<\/a> for estimated taxes.<\/p>\n\n\n\n<p>When a business pays a nonemployee for services, that payment is generally reported on Form 1099-NEC. Under current <a href=\"https:\/\/www.irs.gov\/faqs\/small-business-self-employed-other-business\/form-1099-nec-independent-contractors\/form-1099-nec-independent-contractors\" target=\"_blank\" rel=\"noreferrer noopener\">IRS guidance<\/a>, the reporting threshold for Forms 1099-NEC and certain 1099-MISC payments increased to $2,000 for payments made after December 31, 2025. Just as important, the IRS says worker status is not determined solely by whether a W-2 or a 1099 was issued.<\/p>\n\n\n\n<p>If you are paid through payment apps or online marketplaces, you may also receive Form 1099-K. Under current IRS guidance, third-party settlement organizations generally must issue <a href=\"https:\/\/www.irs.gov\/businesses\/understanding-your-form-1099-k\" target=\"_blank\" rel=\"noreferrer noopener\">Form 1099-K<\/a> when payments for goods or services exceed $20,000, and there are more than 200 transactions, although a platform may still send the form below that federal threshold.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-do-you-need-an-llc-or-corporation-to-be-an-independent-contractor\">Do You Need an LLC or Corporation to Be an Independent Contractor?<\/h2>\n\n\n\n<p>No. Many independent contractors start as sole proprietors. Forming an LLC or corporation is optional, not required, and the tax treatment depends on the entity and any election made with the IRS. The <a href=\"https:\/\/www.irs.gov\/businesses\/small-businesses-self-employed\/single-member-limited-liability-companies\" target=\"_blank\" rel=\"noreferrer noopener\">IRS treats <\/a>a single-member LLC as a disregarded entity by default unless it elects corporate treatment, and a domestic LLC with two or more members is generally taxed as a partnership unless it elects to be treated as a corporation.<\/p>\n\n\n\n<p>From a liability standpoint, an LLC or corporation can help protect personal property from lawsuits, but that protection has limits. The SBA also notes that a business bank account helps keep business funds separate from personal funds, which supports limited liability protection and cleaner operations.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-how-are-taxes-filed\">How Are Taxes Filed?<\/h2>\n\n\n\n<p>For most sole proprietors, the starting point is Form 1040 with Schedule C to report business income and expenses. If total net earnings from self-employment are $400 or more, <a href=\"https:\/\/www.irs.gov\/businesses\/small-businesses-self-employed\/self-employed-individuals-tax-center\" target=\"_blank\" rel=\"noreferrer noopener\">Schedule SE<\/a> is generally used to calculate self-employment tax. Estimated taxes are generally handled through Form 1040-ES.<\/p>\n\n\n\n<p>If the business is taxed as a corporation, the return changes. C corporations generally file Form 1120, while S corporations file <a href=\"https:\/\/www.irs.gov\/forms-pubs\/about-form-1120\" target=\"_blank\" rel=\"noreferrer noopener\">Form 1120-S<\/a>. If an LLC elects corporate tax treatment, it follows the filing rules for that tax classification.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-do-independent-contractors-need-a-business-license\">Do Independent Contractors Need a Business License?<\/h2>\n\n\n\n<p>Not because of the label alone. The <a href=\"https:\/\/www.sba.gov\/business-guide\/launch-your-business\/apply-licenses-permits\" target=\"_blank\" rel=\"noreferrer noopener\">SBA says<\/a> licenses and permits depend on the business activity and the business location, and they can come from federal, state, county, or city agencies. In other words, licensing depends on what you do and where you do it, not simply whether you call yourself self-employed or an independent contractor.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-insurance-needs-for-self-employed-people\">Insurance Needs for Self-Employed People<\/h2>\n\n\n\n<p>Choosing an LLC or corporation does not eliminate insurance needs. The <a href=\"https:\/\/www.sba.gov\/business-guide\/launch-your-business\/get-business-insurance\" target=\"_blank\" rel=\"noreferrer noopener\">SBA notes<\/a> that entity protection has limits, and insurance helps fill gaps. That matters because third-party injury, property damage, professional mistakes, and auto claims can create costs that many small businesses cannot comfortably absorb on their own. Coverage always depends on policy terms, conditions, limits, and exclusions.<\/p>\n\n\n\n<p><strong>General liability insurance.<\/strong> <a href=\"https:\/\/www.businessinsuranceusa.com\/general-liability-insurance\" target=\"_blank\" rel=\"noreferrer noopener\">General liability<\/a> is often a starting point because it can help protect against third-party bodily injury and property damage claims. <a href=\"https:\/\/content.naic.org\/consumer\/small-business.htm\" target=\"_blank\" rel=\"noreferrer noopener\">NAIC notes<\/a> that if someone is injured while visiting your business, you can be held responsible, and SBA guidance describes general liability as protection against losses tied to bodily injury, property damage, medical expenses, libel, slander, lawsuits, and judgments.<\/p>\n\n\n\n<p><strong>Professional liability insurance.<\/strong> If you provide advice, design, consulting, bookkeeping, technical, or other professional services, professional liability may be just as important as general liability. SBA guidance says this coverage is designed for service businesses and protects against financial loss tied to malpractice, errors, and negligence.<\/p>\n\n\n\n<p><strong>Commercial property insurance.<\/strong> If you own tools, <a href=\"https:\/\/www.businessinsuranceusa.com\/artisan-contractor-tools-and-equipment\" target=\"_blank\" rel=\"noreferrer noopener\">equipment<\/a>, inventory, furniture, or lease office or retail space, commercial property insurance can help pay for covered damage to business property. <a href=\"https:\/\/www.sba.gov\/business-guide\/launch-your-business\/get-business-insurance\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">SBA guidance <\/a>describes it as protection against loss or damage to company property from events such as fire, smoke, wind, hail, vandalism, and similar covered causes of loss.<\/p>\n\n\n\n<p><strong>Home-based business coverage or a BOP.<\/strong> Many self-employed people assume a homeowners or renters policy will cover business activity, but <a href=\"https:\/\/content.naic.org\/consumer\/small-business.htm\" target=\"_blank\" rel=\"noreferrer noopener\">NAIC says<\/a> those policies are rarely adequate for a home-based business and often limit business property coverage while excluding business-related liability. NAIC also notes that a <a href=\"https:\/\/www.businessinsuranceusa.com\/business-owners-insurance\" target=\"_blank\" rel=\"noreferrer noopener\">business owner\u2019s policy<\/a>, or BOP, typically combines property, business interruption, and liability coverages.<\/p>\n\n\n\n<p><strong>Workers\u2019 compensation insurance.<\/strong> If you hire employees, <a href=\"https:\/\/www.businessinsuranceusa.com\/workers-comp-insurance\" target=\"_blank\" rel=\"noreferrer noopener\">workers\u2019 compensation<\/a> should be reviewed right away. <a href=\"https:\/\/content.naic.org\/insurance-topics\/workers%27-compensation-insurance\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">NAIC states<\/a> that workers\u2019 compensation is mandatory for most employers in every state except Texas, and state rules can differ on who counts as an employee and whether owners are included or exempt.<\/p>\n\n\n\n<p><strong>Commercial auto insurance.<\/strong> If a vehicle is owned by the business or used heavily in business operations, do not assume personal auto insurance is the best fit. <a href=\"https:\/\/content.naic.org\/consumer\/small-business.htm\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">NAIC notes<\/a> that personal and <a href=\"https:\/\/www.businessinsuranceusa.com\/business-auto-insurance\" target=\"_blank\" rel=\"noreferrer noopener\">commercial auto<\/a> policies differ, and commercial auto typically carries higher liability limits plus provisions for rented and non-owned vehicles used for company business.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-the-bottom-line\">The Bottom Line<\/h2>\n\n\n\n<p>Self-employed is the bigger bucket. An independent contractor is one way of being self-employed, but it is not the only one. The practical takeaway is to get the classification right, use the correct tax forms, confirm licensing with the agencies that regulate your location and industry, and match your insurance program to how the business actually operates.
